Savannah TLA Shares Strategies, Hosts Speakers

Below is an article written by Paul Painter of Painter Law, LLC and the Savannah Trial Lawyers association summarizing the Savannah TLA’s activity in the last 6 months of 2011.

The Savannah Trial Lawyers Association began its August to June business year by welcoming GTLA President Geoff Pope to the coast for cocktails at Bonna Bella Yacht Club, an ironically named flip-flop-and-t-shirt style bar that sits along a tidal creek and overlooks an expanse of marsh.  Geoff’s appearance, along with the unusually cool August evening and vendor-sponsored beer, lured in about 40 local trial lawyers to the 2011-2012 year kickoff event. 

The group then settled into its normal routine of meeting for lunch on the last Tuesday of every month, but with a few new twists.  The venue changed to a private room at the Savannah Golf Club and the meetings were slightly reorganized.  In addition to the usual guest speaker, portions of the meetings were designated for sharing local verdicts, orders, defense tactics, etc.  Parliamentarian Brad Stephens also began giving a monthly report on recent significant appellate court cases of interest.  The highlights of the fall lunch meetings were the presentations by guest speakers Buck Rogers, Rob Kelly and—in one of his first speaking engagements after taking the bench—Chatham County State Court Judge Greg Sapp. 

STLA ended the year with its 2nd Annual Holiday Party at bar at The Marshall House.  In the casual event hosted by Casemetrix, local trial lawyers and local members of the legislature celebrated together; thus, capping off a 2011 full of achievement and setting the stage for more success in 2012. 

Search Hints - Prioritizing Search Criteria

We’ve learned at CaseMetrix that there’s definitely an art to searching.  We’ve seen people who have honed their searching skills to the point where they always find useful cases, so over the next few weeks, we’re going to send out short hints to improve the quality of your results.

The most common mistake we see is going overboard initially with search criteria.  Fairly often, we’ll see results where the user has over-specified the search and come up with very little, or nothing.  For example, it might be a back herniation (non-surgical) with a neck soft tissue injury with $27,000 in medical specials (search range $20,000-$40,000) in a small, rural county where the plaintiff was a female, aged 20-29 and the defendant was cited for DUI.  After running this complete search, the system says there are no cases.
 
To avoid this, prioritize your criteria.  It helps to think of a pyramid where you start at the top with your most important criteria and then work down by watching the counter in the lower right corner of the search screen decrease as you add criteria.

For this case, it’s clearly the back herniation.  Selecting “Back,” then “Herniation, ” then check “Primary Injury”  and “non-surgical.”  At this point, the counter is reading 96 cases.
Adding “Neck,” “Soft tissue” however, takes that number down to 28.  Is it worth losing 71% of the cases because of a modest soft tissue injury?  Probably not.  So don’t include it in the search.
Then, determine your next most important piece of criteria, which is the DUI.  Applying that takes your count down from 173 to 9, which is probably where you want to stop and review the cases.  Always try and work down the pyramid until you end up with 10-20 cases, then review. Since the venue is a more rural county, look for similar locales; you’ll see there are settlements and verdicts in Johnson, Troup and Effingham counties.

Premises Liability Searching Launches May 1, 2011

On May 1, 2011, CaseMetrix will launch Premises Liability searching (click here for an example of the basic search screen, advanced search screen and results screen). Similar to the Motor Vehicle Accident database, attorneys will be able to purchase a subscription, giving a firm 24/7 unlimited searching for as little as $99 per month. If a firm already has a subscription to the Motor Vehicle Accident database they will be able to acquire a Premises Liability subscription at a 50% discount with subscriptions starting from as little as $49 per month. Users will be able to search on a variety of criteria including injury, venue, type incident and type location. Let the system do the searching for you

We are extremely pleased to announce that CaseSave was released over the weekend and is now live!  CaseSave is a free service to CaseMetrix subscribers that allows you to save all your searches (e.g. torn rotator cuff with surgery in Bibb Co. and medical specials between $20,000 and $40,000) under any name you choose (e.g. “Smith v Jones”).  You can save searches on as many cases as you like.  Once the search is saved, CaseSave will search 24 hours a day, 7 days a week looking for new matches as cases are entered by the CaseMetrix network of attorneys.  Once new matches are found, CaseSave will notify you via email with a link to the new cases.  Searches will stay open until you tell the system either to “Suspend” or “Close” the search.

When you next log in, you’ll see a new screen layout under “My Cases” that shows all your draft, pending and approved cases on the left and all your CaseSave searches on the right.  Please take a few minutes to set up searches on any cases you now have open and the system will handle everything else for you!  You’ll never have to wonder again if you missed anything prior to mediation or otherwise settling a case.

Partnering with the Daily Report

We are extremely pleased and proud to announce that The Daily Report, Georgia’s daily newspaper for the legal profession, has chosen to partner with CaseMetrix to provide data for a column on Georgia verdicts and settlements that appears each Monday. 

Reporters from The Daily Report will also occasionally consult with CaseMetrix to add perspective on news stories regarding settlements and verdicts using our proprietary databases.  CaseMetrix will maintain its confidentiality agreements with lawyers who contribute data and honor case anonymity in our CaseSearch product. If attorneys have requested anonymity on certain cases, their identities will NEVER be revealed to The Daily Report in conjunction with that case, unless the submitting attorney gives us explicit permission to do so.

Cases in more than 70% of Georgia’s counties

We recently broke through the 100 county case barrier and now have cases in at least 113 of the 159 Georgia counties.  We are working very diligently with law firms throughout Georgia to try and increase both the number of counties and cases represented in those counties.  We understand that venue is very important in understanding case value and are urging any members of the CaseMetrix network to continue to contribute cases, especially from counties where we have modest or no representation.

More than 2,000 MVA cases and rising!

We’re very happy to announce that we broke through the 2,000th MVA case threshold on July 27th.  It was submitted by Josh Carroll, Esq. from Buzzell, Graham and Welsh of Macon; we had a number of people competing for the prize, but in the end Josh prevailed and won a $250 gift card. In the interim, we’ve received another 244 Motor Vehicle cases and are adding more every day thanks to the continued support of our data contributors.

To get access to the online premises liability form, log in to the secure part of the site and click the Submit Cases tab. We at CaseMetrix are very excited about the idea of building out a comprehensive and easy to use premises liability database for our clients to benefit from but we cannot do it without you. The more cases that everyone contributes, the better the tool will be and the sooner it can be made available so please give generously!

Introducing real-time reporting

To coincide with the GTLA conference, CaseMetrix will be going live with it’s real-time CaseSearch feature on April 17, 2010. From this date, users will be able to search against recently settled or tried Motor Vehicle Accident cases held in the CaseMetrix database and to find cases similar to their own.

Accepting Verdicts on November 15, 2009

We’re now accepting verdicts. Due to an overwhelming demand from our client base, CaseMetrix is now accepting verdict data in Motor Vehicle and Premises Liability cases. In addition to accepting data on verdicts and settlements in Premises Liability cases, we’re also accepting data on cases that have resolved in motions for summary judgment and other dispositive motions. In our Workers’ Compensation data collection form, we are accepting data regarding settlements and administrative law judge awards.
